Introduction:
Although the slogan from the ‘60s of “make love not war” does not normally come to mind for any type of legal proceeding, it actually is an excellent motto or guideline to follow when pursuing a solution through direct party negotiations, third party mediation assistance, or a custom designed arbitration process.
It is through one or more of these processes (rather than the battle field realm of the litigation system) that truly positive solutions for all parties can be produced. The secret lies in laying down the sword and using instead the biblical estate planning principles of real wealth and whole person stewardship as dispute resolution always includes, to one extent or another, the simultaneous management of who we are and what we own.
If the focus by each side in a dispute is on what they want or in winning the argument rather than seeking to find a result that is mutually acceptable to everyone concerned, a great deal of unnecessary time, money and emotion will be expended.
The way to avoid that is through the use of guided negotiations (i.e. mediation) or an arbitration process (designed by the parties themselves with the assistance of a skilled expert). When taking that approach rather than engaging in a litigation war, disputes are not only resolved in a time, money and emotions efficient manner, but also produce a more effective, acceptable result, because the parties have a direct hand its design rather than being dictated to by judge or jury.
This is just one more example of how amazing and applicable the Bible is to real life and everyday issues. It’s also one of many instances in which the observance of God’s Word produces fruits and rewards in this world as well as the next.
